Regulations on Online Gambling in India


With the turn of the 20th century, gambling was highly restricted by the Indian government. Gambling denounced as something that people would get addicted to. People would lose all sense of logic and give in to the temptation to bet beyond their capacity for greater rewards. So, the Indian government decided to take away the right to gamble. But did that stop Indians from being entertained by this age-old pastime? With the advent of the Internet and Technology, an increasing number of people gone online to satisfy their gambling habits. According to a report, about 40% of Internet users in India have admitted to spending some time on online gambling for fun and not with the intention of making money.
Our Project ‘GAMBLING LAWS IN INDIA: SPECIAL FOCUS ON ONLINE GAMBLING’, by NITI MANTHAN, focuses on the evolution of regulations on online gambling.

Medico-Legal Aid and Curative Sciences with legal insertions: Simplifying the medical jurisprudence


The medio-legal jurisprudence in India is vast yet remains an esoteric area. Through this report, Niti Manthan has made an attempt to comprehend and present areas of this jurisprudence including medical negligence, surrogacy, Biomedical waste management, Emergency Protocol in Health Facility, Lights and Siren for Emergency Medical and Services, Grievance Redressal and Health Helpline in India.

Rights and Responsibilities in Physician-Patient relationship in context of Medical Protection Act (MPA)


The medical professionals and patients share a sweet-bitter relation. The doctor is a demi-God if the patient is cured; and its negative counterpart if the patient suffers more. In recent years accounts of doctors being thrashed by patients and their families are making headlines around the world and are frequently circulated on social media as well. At any point in their lives, between 8% - 38% of health workers experience physical abuse. On the other hand, several doctors have also been accused of being motivated by greed and of pursuing unethical methods over time through the commercialization of the medical treatment.

Through this research, Niti Manthan aims to understand the legal framework to balance the interest of patient and doctors; and to facilitate inclusivity in the health law policymaking. The research is amalgamated with a global outlook, and catalyzing holistic healthcare policy which could benefit the masses at the grassroots of India.

Postulating Policy and a systematic model for Climate Change laws in India


This Study seeks to reel in the climate change study and refocus it into the Indian perspective. By analysing various stakeholders, this project sought to analyse the requirements that would need to be met in order to effectively deal with climate change in India. The conclusion of this study saw the proposition of changes required in law, policy, and morals, to not only position India at the forefront of climate change policy but a leader in the resolve required to ensure intergenerational equity, comprehensive change and transition itself into a world leader

INTERPRETATION OF CRIMINAL LAWS AND THEIR HISTORY IN INDIA


The present study was carried out in order to trace the origin of the Common law-driven Criminal Justice System in India and the related developments and reforms. The researchers have carried out an in-depth analysis, in order to study the lacunae present in the substantive and procedural parts of criminal law, and come up with suggestions that can prove to be helpful for society. The research has also been carried out as an effort towards tackling the issue of burden of pendency of cases in the courts in India.
Niti Manthan has considered various aspects of the Criminal Justice System, beginning from the origin of the drafting of penal laws to the most recent amendments in the Indian Penal Code, 1860and the Code of Criminal Procedure, 1973 and their impact. Further, the study enlists various shortcomings that came out after a thorough reading of certain sections of the IPC and the CrPC.

CELRA examines environmental law and its jurisprudence in India and its scope in the international community and streamlines the process to work towards climate change and sustainability through law and effective policy. We are dedicated to expanding the scope of inclusivity of environmental policy and try ensuring that all stakeholder's opinions are regarded in its policymaking. Handbook on Comparative Cyber Laws and Cyber Crime


The world is becoming more real in the virtual dimension than in the tangential plane.
The rapid development of the Information technology has proved to be a factor to
connect the world in one of the most efficient ways ever. With the change in dynamics
of human interactions catalysed by the cyber space, the area inevitably requires certain
regulations and protocols to facilitate the flawless space for interactions, transactions
and growth. The globe, in last two and half decades has witnessed several protocols and
legislations in this respect, on both domestic and international fronts. Today, when
delinquents are increasingly shifting their base to the virtual space, the analysis of all
these regulations is necessary to prevent and combat an assault on our cyber property or
identity. In this report, we have made an attempt to condense the IT Law protocols, right
from complaint register mechanism, jurisdictional, and investigation issues to the
tenability of judgments.

The Impact of Virtual Courts In Behavioural Changes of The Indian Legal System


In the wake of the Covid pandemic, the jurisprudence system was marshalled for a much-needed innovation of holding court virtually. This helped facilitate justice dispensation even in times where social distancing was mandatory and necessary. This contrasted with the physical hearings where the lawyers, judges, and clients are all present in the court at the time of the hearing. This study explores the behavioural changes observed during this sudden shift from Physical Courts to Virtual Courts. The present study is a psychological & legal analysis of the E-Courts Policy that brought digitalization to the Indian Court System.

The modern world is witnessing the mushrooming of the urban centres in about past one century. With the movement of workforce from primary to tertiary sector is catalyzing this process. With urbanization comes a responsibility upon the state for city planning. The Union is coming up with the concept of “smart cities”. Being the national capital, it is expected that the flow of urban infra policies in Delhi should be of prime standards and a model to replicate. But does the city stands up to the expectations?
Niti Manthan conducted an empirical study in the North Delhi Municipal
Corporation area of New Delhi to analyze the implementation of a newly enacted
policy for the street vendors.

Handbook on Media and Technology Laws in India


Dissemination of information and knowledge has always been an activity of prime importance in
any community. So much so that at the time of creation, the creator Lord Brahma assigned this
task to his very own son Narada. Whenever society takes a turn, these modes of information
dissemination are always around; At times as the cause and always as the informant of change.

If this extensive is the power and the potential of media, it also became important to regulate
this field. Certain regulations, legislations and self-regulatory norms were laid down for the
media houses to ensure that information is disseminated among the masses in a fair and truthful
manner. A sub-team from the Media and Democracy research team of Niti Manthan has prepared this Handbook to summarise the legal positions, regulations and enactments which govern the information
dissemination and media platforms in India.

Analysis of FDI Policies of India : Insights w.r.t. COVID-19


Foreign Direct Investment (FDI) plays an important role in the economic development of a country. The capital inflow of foreign investors allows strengthening of infrastructure, increasing productivity and creating employment opportunities in India. Additionally, FDI acts as a medium to acquire advanced technology and mobilize foreign exchange resources. The COVID-19, although a healthcare pandemic, is fast turning into a global economic pandemic. Its economic costs are likely to be massive across the world and to India as well.
On one end we see the forex reserves in India are on an all-time high, on another the perpetual lockdowns slowing the local economy. This dichotomy seems to be a puzzle for students of economics.

Through this research, conducted in 2020, the student researchers have analysed the Foreign Direct Investment policies in India, in the context of contemporary Covid-19 pandemic situation.

Labour Law and Menstrual Health


“Women constitute 50% of our population, and if they are doing not begin and work, then
our country will never grow at the pace we all envision it to grow, and for that very reason,
governments over time have taken special care to enact and amend laws to make sure
greater participation of women within the growth story of India.”
As a frequently recurring phenomenon, menstruation brings along with it a variety of problems such as dysmenorrhea, premenstrual syndrome and endometriosis. This report analyzes the provisions in labour laws and policies, across the globe, to cater to the needs of the women workforce during the menstruation period.
